Terms of Service

These terms are between you and Moja Switch Limited ("Moja Switch", "we", "us"), a corporation incorporated under the laws of Canada. Moja Switch is a business-to-business payment infrastructure company. We provide orchestration, settlement, and related services to banks, payment service providers, remittance companies, and fintechs. We are registered with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a money services business, registration number N300001168. We are not a bank, and we are not registered with the Bank of Canada as a payment service provider.
The first part of these terms covers mojaswitch.com and a business enquiry. It does not give you access to the platform, the API, or a commercial rate. A business uses Moja Switch only under a written partner agreement. That agreement controls fees, service levels, data, and liability between Moja Switch and that business.
The second part covers Moja Pay. Moja Pay is a separate consumer service of Moja Switch Limited. Those sections apply only if you use Moja Pay. They do not apply to a partner.
The Moja Switch website
You may use mojaswitch.com to read about the platform and to contact us about a business relationship. Sending a message through the site is a request for information. It is not an order, and it does not create a partner agreement. You may not misuse the site, interfere with it, or use it to send unlawful content.
Descriptions of corridors, APIs, and availability on the site are informational. The rights a partner receives are the rights written in its agreement.
Moja Pay
Moja Pay lets an individual in Canada send a personal transfer. You cannot store money in the app. You may open a Moja Pay account only if you are at least 18, you live in Canada, you send money for yourself from your own Canadian bank account, you complete the identity check we require before your first transfer, and the information you give us is accurate.
By creating a Moja Pay account and accepting the terms shown in the app, you agree to the Moja Pay sections of these terms. The version you accept in the app applies to your account until you accept a later one.
You must keep your PIN and your device private. You are responsible for transfers confirmed with your credentials unless you have told us, at support@mojaswitch.com, that those credentials are no longer safe.
A Moja Pay transfer
Before you confirm a transfer, the app shows you the amount you pay in Canadian dollars, any fee, the exchange rate, the total cost, and the amount the recipient should receive. That screen is the offer for that transfer. The customer rate includes our spread over the reference rate we use for the corridor. A quote expires. If it expires, or if the amount the recipient would receive changes, you must accept a new quote before the transfer proceeds.
You pay from your own Canadian bank account by a method the app offers, which may include Interac e-Transfer, a one-time pre-authorized debit, or bill payment. We may use other licensed businesses to collect those funds and to deliver the payout. The names shown in the app before you confirm are the names that apply to that transfer.
You can cancel a transfer until we have received your payment. After we have received it, the transfer cannot be cancelled. We do not promise the hour the recipient will be paid. We show the status in the app. If a transfer does not complete and we have received your payment, we return it to the account you paid from. A mobile-money operator or receiving bank may apply its own charge. We disclose that charge when we know it.
Moja Pay text messages
Moja Pay sends one-time passcodes by text to the mobile number you enter in the app. A code is sent only after you request it, to create an account or to sign in. Each code expires in 10 minutes. Do not share it. Moja Switch does not send these codes to its business partners.
Message frequency varies based on how often you request a code. Message and data rates may apply. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Reply STOP to opt out. After you opt out, Moja Pay sign-in by text will not work until you opt in again by requesting a code in the app or by replying START. Reply HELP for help, or email support@mojaswitch.com. How we handle your number is described in the privacy policy.
Moja Pay restrictions
You must not use Moja Pay for anyone other than yourself, give us false identity information, try to bypass an identity check, a limit, or a sanctions screen, or interfere with the app or another customer's account. We may refuse, delay, or reverse a Moja Pay transfer, and we may suspend or close a Moja Pay account, when we need to follow the law, a sanctions list, a court order, or a reasonable fraud concern. We will tell you when the law allows us to.
You may ask us to close your Moja Pay account at any time, at support@mojaswitch.com, when no transfer is in progress. Closing it does not erase records we are required to keep. We keep Moja Pay identity and transfer records for at least five years from the day the record is created.
Complaints and liability
A business partner raises a platform issue under its partner agreement. A Moja Pay customer can write to us in the app under Help and support, or email support@mojaswitch.com. For a Moja Pay payment or refund, email finance@mojaswitch.com. For privacy or an identity check, email compliance@mojaswitch.com. Raise a problem with a Moja Pay transfer within six months of the transfer date. We will acknowledge a Moja Pay complaint and tell you if we need more than 30 days to resolve it.
For Moja Pay, we are responsible for providing the service these terms describe. We are not liable for loss caused by a bank, a mobile-money operator, or another institution that is not acting for us, except where the law does not allow that limit. We do not exclude liability for our own fraud or gross negligence, or any liability that Canadian law does not allow us to exclude or limit. Nothing in these terms removes a right a Moja Pay customer has under the consumer protection law of their province or territory. Liability to a business partner is set only in that partner's agreement.
Changes, law, and contact
We may update these terms. We will post the new version on this page and change the date above. If a change is material to a Moja Pay account, we will tell you in the app and, where required, ask you to accept the new version before you send another transfer. A change to a partner relationship is made in that partner's agreement.
These terms are governed by the laws of Canada applicable in Alberta and by the federal laws of Canada. A court in Alberta may hear a dispute, without taking away a right a Moja Pay customer has to bring a claim in their home province.
